About this practice group

Few firms in the region have developed dedicated capability at the intersection of food regulation, agricultural trade, food technology, and cross-border regulatory compliance. Peter Ong & Nair’s Food Law & Agri-Tech Practice Group does.

OECD–FAO projections indicate that Asia and the Pacific accounted for approximately 54% of global agriculture and fish production between 2022 and 2024, with total regional output expected to increase by 14.5% by 2034. At the same time, ASEAN accounted for approximately 9.5% of the EU’s total agri-food imports in 2024, with trade value continuing to grow into 2025.
 

For Asian businesses engaged in this corridor, whether as producers, processors, traders, aquaculture operators, or food technology ventures, the applicable legal frameworks are multi-layered and technically detailed. These frameworks require careful coordination across jurisdictions to support market access, product integrity, and commercial operations. The legal considerations in this space engage multiple, often concurrent, bodies of law. Regulatory compliance, product approval, labelling requirements, intellectual property protection, contractual structuring, and supply chain due diligence obligations do not operate in isolation. Addressing them effectively requires a coordinated approach that takes into account both domestic frameworks and the regulatory environment of the destination jurisdiction.
 

We advise food businesses, agri-tech ventures, producers, traders, and investors, including those operating across aquaculture and seafood supply chains, on the legal dimensions of operating in and across regulated food and agricultural environments. Our practice covers regulatory compliance, product integrity, intellectual property, trade structuring, and the legal considerations arising from food innovation, including novel foods, alternative proteins, and technology-driven agricultural applications.

A significant part of our work involves supporting Asian businesses in navigating the legal requirements applicable to their engagement with European food and agricultural regulatory frameworks. Where matters require jurisdiction-specific advice, we work in coordination with European counsel to ensure that legal positions are grounded in the applicable requirements on both sides of the relationship.
 

Our work in this space also extends to aquaculture and marine-based food systems. In this context, we support clients on regulatory, sustainability, and supply chain considerations arising from aquaculture operations, marine resource use, and evolving traceability and environmental requirements in cross-border trade.

Scope of Work

Advising food businesses, producers, and agri-tech ventures on compliance with food safety legislation, product approval requirements, import and export conditions, and labelling obligations under Malaysian law and in the context of cross-border regulatory frameworks across Southeast Asia and other relevant jurisdictions, including those relating to food, agricultural, and aquaculture products.

Supporting clients on food-related intellectual property matters, including geographical indications, trade mark protection for food products, protected designations of origin, and the structuring of proprietary formulations and processes. This includes advising on ownership, licensing, and contractual protection of intellectual property, as well as coordinating with foreign counsel to ensure that rights are appropriately recognised, enforced, and commercially structured across jurisdictions.

Advising on the legal frameworks governing food technology and product innovation, including novel food authorisation requirements, the regulatory treatment of alternative proteins and lab-grown products, and the legal classification of technology-driven agricultural applications, with reference to applicable regulatory approaches in Malaysia and relevant foreign jurisdictions.

Assisting Asian businesses, including those in Malaysia, Southeast Asia, and the Middle East, in understanding and addressing the legal requirements applicable to their engagement with European food and agricultural regulatory frameworks, including import and border control requirements, traceability obligations, and sustainability-linked regulatory developments.

Advising on supply chain-related legal considerations, including contractual risk allocation, due diligence requirements, and the legal implications of sustainability and traceability obligations embedded in cross-border agri-food and aquaculture trade relationships.

Asia-Europe: Cross-Border Regulatory Coordination 

 

 

European-facing food and agri trade engages a range of legal considerations, including product compliance, labelling, import conditions, traceability, and supply chain obligations across jurisdictions. These issues arise at different stages of a business’s operations, including product development, commercialisation, scale-up, and export into new markets.
 

Peter Ong & Nair supports clients on the legal aspects of these cross-border activities. This includes advising on product classification, labelling positions, import and border requirements, traceability obligations, and the contractual structuring of cross-border supply chain, distribution, and commercial arrangements involving food, agricultural, and aquaculture products.
 

Our role is to assist clients in assessing their legal position, structuring documentation, and addressing the interaction between regulatory requirements and cross-border commercial arrangements. Where matters engage European law directly, we coordinate with European counsel to ensure that the legal analysis reflects the applicable requirements in the relevant jurisdiction and is aligned with the broader cross-border framework.
 

This work is supported by our cross-border practice and regular engagement across Europe. Our counsel frequently travels to and works across European jurisdictions, which strengthens our practical understanding of how legal, regulatory, and commercial considerations operate in the context of cross-border food and agri trade.
